WHAT IS SEXUAL ASSAULT?  WHAT IS CONSENT?

 

Sexual Assault:

A person commits sexual assault by intentionally or knowingly engaging in sexual intercourse or oral sexual contact with any person without consent of such person (Arizona Revised Statutes 13-1406).

Acquaintance Rape:

The assailant is known to the individual and exploits this familiarity to force him or her into unwanted sexual activity.  This behavior is criminal sexual assault under the law.

What is Consent?:

Hearing or saying a clear and sober "YES" to the question, "Do you want to have sex/make love?"... is consent.

Sexual history, type of clothing, and dating history... do not imply consent.

Dressing in a sexy way, drinking a lot, enjoying kissing or someone's else's company... are not consent.

A person who is incapable due to mental disorder, drugs, alcohol, sleep, age, or use of threats of violence... is not capable of giving consent.

Remember:

No one has the right to force sexual contact on another person.
You have the right to be believed.
You have the right to say no.
You have the right to have support.
You have the right to be treated in a supportive and non-judgmental manner.
You have the right to make your own decisions.
