Why should a tribe develop an air quality management program?

Maintenance and Protection of Air Quality and Other Resources

Protect the health and welfare of people living on and near the reservation, which may be compromised due to levels of air pollution from on- and off-reservation sources.

Protect cultural resources and sacred sites from degradation due to acid deposition and impacts to visibility.

Regulate industries, facilities, and other activities contributing to air pollution within the reservation boundaries.

Assertion of Tribal Sovereignty

The Tribal Authority Rule (TAR) of the Clean Air Act (CAA) provides tribes with the opportunity to manage air resources within the boundaries of their reservations. Achieving the capacity to do so with a federally approved tribal air program, further asserts a tribe’s sovereignty over their natural resources.

Reduction of the Data Gap in Indian Country

States, counties, and municipalities have supplied much of the existing data regarding air quality and sources of air pollution in Indian Country. It is possible the data supplied by state and local agencies doesn’t accurately reflect the condition of air quality on tribal lands. By conducting data collection efforts such as ambient air monitoring source identifications, or emissions inventories, tribes can help fill the “data gap” in Indian Country. Data gathered through these efforts can potentially be incorporated into improved air pollution standards and regulations.

What is the Tribal Authority Rule (TAR)?

The 40 CFR Parts 9, 35, 49, 50, and 81 contain the final rule titled "Indian Tribes: Air Quality Planning and Management," which has come to be called the "Tribal Authority Rule" or "TAR."

The TAR authorizes eligible tribes to undertake implementation of their own federally approved air programs.

The TAR delineates specifications that tribes must meet in order to be eligible to implement their own federally-approved air programs.

Eligibility determination (originally referred to as "treatment in a manner similar to a state")

Flexibility in implementation (also called "modular implementation" or "modular approach")

What is a federally approved Tribal Air Program?

Tribes have the authority to regulate air quality on tribally owned lands, without having federal approval under the Clean Air Act (CAA).However, in order to regulate air quality on all land within exterior reservation boundaries, tribes must have an air management program that has been recognized and approved by the USEPA. Tribes must meet certain requirements, as outlined in the Tribal Authority Rule (TAR) of the CAA, in order to be eligible to manage a federally enforceable air program.

Some common types of activities conducted in a federally approved Tribal Air Program include, but are not limited to:

Note 1: Tribes do not need a federally approved Tribal Air Program in order to conduct air quality assessment and education activities. However, having the federal approval to manage tribal air quality by implementing provisions of the Clean Air Act expands tribal jurisdiction to all lands within the exterior reservation boundaries (and other tribal lands), and makes the provisions enforceable in federal courts.

Note 2: The TAR stipulates that tribes can choose a modular approach to implement different programs of the CAA according to their needs and capacities.

How does tribal sovereignty relate to a federally approved Tribal Air Program?

The Tribal Authority Rule (TAR) gives federally recognized tribes the ability to implement a federally enforceable air program for reservations and other tribal lands.

One part of the TAR, called modular implementation, gives tribes who are conducting federally approved tribal air programs the choice to implement any or all of the CAA programs, according to their individual air quality needs or administrative and regulatory capacity.

The TAR also addresses the issue of tribes regulating non-tribally owned lands within exterior reservation boundaries. A US Court of Appeals ruling specifies that all lands within the exterior boundaries of a reservation fall under the jurisdiction of the tribe, for purposes of enforcing air quality regulations.

EPA’s 1984 Federal Indian Policy outlines the working principles of EPA’s involvement in managing the environment on tribal lands. Similar information can also be found in the EPA’s American Indian Environmental Office document Resource Guide for Working with Tribes.

STARTING FEDERALLY SUPPORTED AIR PROGRAM ACTIVITIES

What financial assistance is available for tribes interested in assessing air quality or managing an air program?

Funding through the US Environmental Protection Agency is available to tribes needing financial assistance for conducting the activities of a Tribal Air Program (TAP).

Indian General Assistance Program (IGAP) grants are available to all federally recognized tribes who are interested in developing their environmental management capacity.

Section 103 of the Clean Air Act (CAA 103) grants are available to federally-recognized tribes interested in developing their air programs through projects such as monitoring, emissions inventories, or other activities.

Section 105 of the Clean Air Act (CAA 105) grants are available to federally-recognized tribes who have conducted data gathering activities under a CAA 103 grant, and who are interested in implementing a federally approved Tribal Air Program.

Performance Partnership Grants (PPG) are available to federally-recognized tribes who are interested in combining funds from one or more grant programs into one or more PPGs (i.e., combine air and water grants into one or more PPGs). A Tribal Environmental Agreement (TEA) can be used as a work plan for PPGs.

What technical assistance is available for tribes interested in assessing air quality or managing an air program?

Staff knowledge and professional development is critical for a successful air program.Technical assistance, training and educational programs are available through many agencies and organizations across the US.Training and education on a variety of technical and administrative factors of air quality management is available from basic to advanced levels.

The Institute for Tribal Environmental Professionals (ITEP) provides extensive resources to federally recognized tribes that are beginning or advancing their tribal air program.Most programs offered through ITEP are provided at no cost to tribal environmental professionals.

The American Indian Air Quality Training Program offers several training courses throughout the year, at locations across the US.

The Professional Assistance provides specially tailored technical assistance to tribes.

The Air Pollution Training Institute (APTI) is a USEPA program that provides technical training to interested parties.APTI offers classroom, telecourse, web-based, and self-instructional courses in air pollution management at no cost to tribal employees, except travel and lodging costs.APTI also supports specialized training at Rutger’s University Environmental and Occupational Health Institute, University of Cincinnati Environmental Training Institute, and University of Texas at Arlington Air Pollution Training Academy.Tribal staff are exempt from registration fees for APTI trainings.

The California Air Resources Board (CARB) offers extensive air quality compliance training, primarily in a classroom format.Their main focus is inspection, compliance and enforcement, but they offer many levels of technical training for air quality and environmental professionals.Tribal staff are exempt from registration fees for CARB’s 100 and 200 level training courses.

The Western States Air Resources Agency (WESTAR) offers technical training courses related to air pollution control, in classroom-style seminar and conference settings.Tribal staff are exempt from registration fees for WESTAR training courses.

Additional resources for training and technical assistance can also come from Inter-Tribal organizations, Regional Planning Organizations, the EPA [*EPA Regional Air Contacts] (especially Regional Offices), and other regional, state, local and tribal air agencies (through networking and collaboration efforts).

ASSESSING TRIBAL AIR QUALITY

How can the tribe determine a need for an air quality management program?

Before beginning an air program, a tribe should determine the need for such a program, as well as the potential extent of it.Assessing the air quality can be helpful in determining this need.These assessments could include:

Visibility Assessments

Make observations about the range of visibility of certain horizons or vistas

Conduct monitoring with air quality monitors and/or cameras

If your tribal community is concerned with degrading visibility of scenic or sacred areas, different types of visibility monitoring can be incorporated into a tribal air program as a way to help control the visible effects of air pollution.

Health Assessments

Conduct formal or informal interviews with local clinics and hospitals, as well as with community members

Consider the elevated risk of respiratory problems in children and the elderly, such as asthma, emphysema, and similar health concerns

Indoor air quality can affect health, particularly for people who work indoors

Human health can be negatively affected by eating contaminated foods (crops and game).Toxic substances from the atmosphere travel to the earth’s surface with rain and snow and by gravity; these substances can accumulate in foods, and transfer to people who consume these foods.

Cultural and Community Assessments

Organize data gathering efforts within the region or community, such as conducting surveys or polls of community concerns or activities relating to air quality

Conduct formal or informal brainstorming or observations about what types of activities might be affecting air quality, or what types of activities might be affected by air pollution.

USEPA Nonattainment Areas for Criteria Pollutants

Contains links to information on the criteria pollutants, areas of nonattainment for each (or all) criteria pollutants. OUTREACH AND EDUCATION

How can public outreach and education be optimized?

Public education and outreach has the potential to be the strongest part of a tribal air program, particularly when the main air quality concerns affect the community or tribe, or are a result of regional/community actions.

Various resources can be utilized for education and outreach:
